Welcome to the terms and conditions page of Au Pair World Ltd. 

We are sorry that we now need to adopt a formal tone, we realize that this is a family site and that many of you will be daunted at the prospects of reading and being bound by a formal legal agreement when all you really want to do is to find an au pair.

We are sorry are about this but would like to assure you that these  terms and conditions have been drafted just as much for your own personal protection and enjoyment of the site as well as ours and other members protection.  

We have divided the terms and conditions into several sections. You should read the document as a whole as you will be bound by all of it.

However for your ease of reference we have listed each of the sections below. You may click onto any one of the links to go straight to that paragraph.

1. INTRODUCTION

These are the Terms and Conditions that will govern your use of Au Pair World.
By using this site  i.e. viewing the site; registering as a member; writing to other members; receiving and reply to correspondence from other members or any other activity that you perform on the site,  you are indicating your agreement to be bound by these terms and conditions.
In other words, if you do not wish to be bound by these terms and conditions you should leave the site now. Your continued use of the site for whatever purpose you may choose to use it for confirms your implicit agreement to be bound by the following terms and conditions. 
These conditions may be varied at any time and without notice. Your continued use of the site will signify your acceptance of the varied terms.

2. Information provided by you

• You undertake that your use of the site will be for your own private and domestic use only.
• You MUST be eighteen years old or older to use this site (if you are under 18 and wish to join our site you will need to contact us and obtain our prior permission) .
•  
• You warrant that all details you provide to Au Pair World are  for the purposes of seeking/hiring and employing  an Au pair, nanny or for the purpose of being employed or hired by a host family/Au pair family ; that the details you give  are true, accurate, current and complete in all respects; and that the credit or debit card you use to pay for your membership or maintain your membership is your own and that there are sufficient funds in your account to cover payment of your membership of Au pair world.
• You agree that e-mail can be used as a long-distance means of communication.
• During the registration process, you must choose a username and password. You are responsible for all actions taken under that username and password and must only contact and correspond with other members of the site under your own username and password.
• You are asked to keep your password secure and safe and not to disclose it to anyone. If you suspect or think that someone else might know it or has access to it then you must change it immediately.
• You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password. If there are any changes to the details supplied by you it is your responsibility to change this on your profile page or where necessary to inform Au Pair World of the changes.

3.Information provided by Members ( our disclaimer policy)

This part of the contract covers our disclaimer policy:  i.e.  The part of the contract in which we inform you that we cannot be held liable for any misinformation or acts that you may receive from other members.

At Au Pair World we do our very best to provide an accurate database of information of our  members. The purpose of the database is twofold ;

• To enable  family members to find a suitable Au pair or nanny 
• To enable Au pair and nanny to find a suitable host family.

 

 Our principle role in this process is to provide an information platform’ for our members to be able to exchange information between themselves. However in providing this platform Au Pair Worldcannot take responsibility or accepts any liability for the accuracy, quality, quantity or relevance of any information provided by families, agents or applicants in general, nor for the suitability of any specific family, agent or applicant. We use the terms  Au Pair, Nanny, Housekeeper, Babysitter, Family, and Agent only for convenience. There has been no intent whatsoever to convey any meaning of recommendation or approval of any of our members.
Further,  that  the use of the term Au Pair does not in any way mean  that the Au Pair Member is able to travel to or remain in the country of residence of the Family. We strongly recommend that you take appropriate advice  from the appropriate bodies in your country regarding visa, work permit, police registration, taxation, worker registration, and national insurance. Families are advised to take further specialist independent advice regarding the protection of their property during a placement.
Furthermore, that all matters which may occur between Members, yourself and or your representatives and other contacts made, deriving directly or indirectly from information provided by this web site, are strictly outside the control or responsibility of  Au pair world Ltd. You accept that Au Pair World has no liability thereof.

 

In summary,  by using the ‘information platform’ provided by Au pair world, you agree, and understand that registration and use of any of our services does not in any way create a relationship of agent, employer or employee between you and Au pair world or Au pair world Ltd and other members.

4. Prevention of fraud and scams

It is unfortunate in the times that we live that professional scammers now specifically target Au pair agencies posing as genuine families, Au pairs or nannies with the intent of conning  members of money.
Please read our scam notice for more information.

Au Pair World seeks to protect its members from fraud and online scams and to also keep our site free from online scammers.  To achieve this we have devised a few rules that will discourage them from registering on our site.

 

Accordingly;

 

It is a fundamental condition of membership and use of this site that members will not in any manner or form attempt or seek to induce or obtain any form of monetary advance (payment in advance) or prior monetary assistance (including financial assistance to obtain visa and  plane tickets) from other members prior to their arrival and employment at the host family home. Members are asked to immediately notify us if another member attempt to induce any form of advanced monetary assistance from them.
Au pair and nannies undertake that they have sufficient funds and the appropriate means and documents to obtain a visa to arrive at the host families home and that apart from obtaining a letter of invitation from the family, that they will not seek any form of monetary assistance(advance payment) ,  for whatever purpose  or reason and however genuine or not , from host families home.
Host families undertake that they will not seek, whether by themselves, their agents or third parties, to obtain any form or type of advance payment or monetary advance from the Au pair or nanny for whatever purpose (including obtaining a visa through travel agents). 

• Au pair World will rigorously protect its members from fraud and scams  and will always seek to prosecute to the fullest extent of the law anyone caught deliberately entering fictitious details with the intent of maliciously trying to scam, con or deceive our members to send them advance payment or monetary gains of whatever form.

5. Reservation of right to end agreement

• Au pair world reserves the right to end our agreement with you and to suspend or terminate your access to the site immediately and without notice to you if:-
• you fail to make payment to us when due.
• you breach any of our terms and conditions.
• you fail to provide us, within a reasonable time frame, enough information to enable   us to check the accuracy and validity of any information .supplied by you, or your identity.
• we suspect you have engaged, or are about to engage, or have ways  of being involved in fraudulent or illegal activity on Au pair world agency.com.
• you have asked a member of our site or indeed any other site  to provide monetary assistance to you. 
• you upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software;
  You upload or post any information or advertisement that may be considered as competition to au pair world.
  You use or display offensive language, imagery, obscenity, or pornography or any other material that could be conceived of as offensive by other members or that could give rise to any civil or criminal liability towards Au Pair World  or  which  could violate any laws or regulations of any governing body having jurisdiction over Au pair world its subsidiaries, affiliates or users;
• Solicit any relationship other than employer/employee related to child care as may be found through this Service

6. Third Party Information

During the course of your perusal of our site you will notice that we have given you links to many external relevant third party sites. The links to these sites has been given purely to aide you in your endeavours.  We do not give any warranty as to any information provided by these sites.
We cannot be held responsible for material displayed on third party websites or any other written material. Members are advised to use their won discretion when viewing these sites.

7. Your Privacy

Naturally we collect and present personal information on families, nannies and au pairs as part of our service to our Members. By becoming a member of the site the member implicitly consents to our storage and processing of personal data for the purpose of this site.

We confirm:-

• We  only use information about our Members for the purposes of this site.
• We do not sell or provide Members’ information to any other commercial organization for other uses.
• Members of the Au pair world are just as concerned as you are to protect Members’ privacy.
• Only registered Members of the  Au pair world  can see personal information. It is not available to unregistered visitors.
• Family Members can see personal information about au pairs and nannies, but cannot see personal information about other families.
• Premium Family Members can see contact information about au pairs and nannies.

• Au pair and nanny Members can see all information about families, except their contact information
•  We will never ask for personal details via email. If you receive an unsolicited email asking you for your Au pair world.com in details, please contact our Customer Service team immediately.

We require that Members respect the confidentiality of the data provided, do not share it with any third parties, and make no use of it other than in connection with the purposes of the web site" and in particular, but without limitation, do not use it for commercial purposes.

8. Intellectual Property, Software and Content

 

The intellectual property rights in all software and content made available to you on or through this Website remains the property of Au pair world or its licensors and are protected by copyright laws and treaties around the world.

 

 Au pair world has reserved all such right to themselves and their licensors. You are permitted to  store, print and display the content supplied but this will be  solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.
You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by Au pair World or its licensors.

9. Governing Law and Jurisdiction

These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.

Survival

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Entire agreement

These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties.  You confirm that, in agreeing to accept the Conditions, you have not relied on any representation except where that representation has been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your statutory rights are not affected by these terms and conditions.
